Terms of Service
Welcome to Midsommardans (“Midsommardans,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of https://www.midsommardans.org/ (the “Site”) and any related services, including event information, registration, ticketing, and donations (together, the “Services”). Midsommardans is a non-profit organization organized under the laws of Sweden that hosts an annual dance festival. By accessing or using the Site, purchasing a ticket, registering for an event, or otherwise using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.
1. Who We Are
Midsommardans is a non-profit organization based in Sweden that organizes the Midsommardans dance festival and related events. Questions about these Terms or our Services can be directed to midsommardans@gmail.com.
2. Eligibility and Accounts
You must be able to form a legally binding contract to use our Services. If you are under the age of majority in your jurisdiction, you may use the Site only with the involvement and consent of a parent or guardian.
Some features (such as ticket purchases or event registration) may require you to provide accurate, current, and complete information, such as your name, email address, and payment details. You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account.
3. Tickets, Registration, and Payments
3.1 Ticketing Platforms
Ticket sales and payment processing for the festival are handled through third-party platforms, including Stripe and Fienta. When you purchase a ticket or make a payment, you will be directed to or interact with these third-party services, and your use of them is also governed by their respective terms of service and privacy policies. We do not store or process full payment card details ourselves.
3.2 Pricing and Availability
All prices are listed in the currency shown at checkout and are subject to change without notice until an order is completed. We make reasonable efforts to ensure accuracy of event details, pricing, and availability, but errors may occur, and we reserve the right to correct them.
3.3 Refunds and Cancellations
Unless otherwise stated at the time of purchase or required by applicable law, ticket sales and registration fees are non-refundable. If Midsommardans cancels, postpones, or materially changes an event, we will make reasonable efforts to notify registered participants and will address refunds or credits on a case-by-case basis, consistent with our published policies at the time.
3.4 Donations
If you make a voluntary donation to Midsommardans, that donation is generally non-refundable except as required by law. As a non-profit, we appreciate your support and will use donations to further our mission of organizing the festival and related community activities.
4. Event Participation
Participation in the Midsommardans festival, workshops, or related activities is at your own risk. Dancing and related physical activities carry an inherent risk of injury. By registering for or attending an event, you acknowledge this risk and agree to follow any venue rules, codes of conduct, or safety instructions provided by organizers, instructors, or venue staff.
We reserve the right to refuse entry, remove, or deny participation to anyone whose conduct we reasonably believe is unsafe, disruptive, or in violation of our code of conduct or these Terms, without refund.
5. Acceptable Use
When using the Site or Services, you agree not to:
● Violate any applicable law or regulation;
● Provide false or misleading information when registering or purchasing tickets;
● Resell or transfer tickets in a manner that violates the ticketing platform's terms;
● Attempt to interfere with, disrupt, or gain unauthorized access to the Site or its systems;
● Use the Site to harass, abuse, or harm another person;
● Copy, scrape, or reproduce Site content for commercial purposes without our written permission.
6. Merchandise Store
Midsommardans may operate an online store selling festival merchandise (the "Store"). This section applies whenever you purchase physical goods from the Store, in addition to the other provisions of these Terms.
6.1 Orders and Payment
By placing an order through the Store, you make an offer to purchase the item(s) at the listed price. We may accept or decline any order, including in cases of pricing errors, stock unavailability, or suspected fraud. Payment is processed through Stripe or other providers we designate; a contract is formed only once we confirm your order.
6.2 Shipping
We aim to ship orders within a reasonable time after purchase. Shipping costs, delivery estimates, and available destinations will be shown at checkout. Risk of loss passes to you once an item is delivered to the address you provided.
6.3 Right of Withdrawal (14-Day Cooling-Off Period)
If you are a consumer purchasing from within the EU/EEA, you have the right to withdraw from your purchase within 14 days of receiving the goods, without giving any reason, in accordance with EU distance selling rules (Directive 2011/83/EU) and Swedish law (Distansavtalslagen). To exercise this right, contact us at midsommardans@gmail.com before the deadline expires, clearly stating your intention to withdraw.
Exceptions to the right of withdrawal include: goods made to your specification or clearly personalized, and goods that are unsealed and unsuitable for return for health or hygiene reasons (such as certain apparel, once removed from its packaging and worn).
6.4 Returns and Refunds
If you withdraw from your purchase, you must return the goods to us without undue delay and within 14 days of notifying us, in their original condition where reasonably possible. Unless the goods are faulty or not as described, you are responsible for the cost of return shipping. Once we receive and inspect the returned goods, we will issue a refund to your original payment method within 14 days, which may include the original delivery cost (excluding any extra cost if you chose a delivery method other than our standard, least expensive option).
If an item arrives damaged, defective, or not as described, please contact us at midsommardans@gmail.com with photos and your order details, and we will arrange a replacement, repair, or refund at no cost to you, consistent with your statutory rights as a consumer.
7. Content and Intellectual Property
Unless otherwise noted, the text, graphics, logos, photos, and other content on the Site are owned by or licensed to Midsommardans and are protected by copyright and other intellectual property laws. You may view and share Site content for personal, non-commercial purposes, but you may not reproduce, modify, distribute, or create derivative works from it without our prior written consent.
If you submit photos, testimonials, or other content to us (for example, by tagging us on social media or submitting materials for use on the Site), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with promoting the festival, unless you tell us otherwise.
By attending our events, you acknowledge that photography and video may be taken for promotional and archival purposes, and you consent to your likeness appearing in such materials unless you notify us in advance in writing.
8. Third-Party Links and Services
The Site may contain links to third-party websites or services, including Stripe, Fienta, and social media platforms, that are not owned or controlled by us. We are not responsible for the content, policies, or practices of any third-party sites or services. Your interactions with those third parties are solely between you and them.
9. Disclaimers
The Site and Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by applicable law. We do not warrant that the Site will be uninterrupted, secure, or error-free.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Midsommardans, its organizers, volunteers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Site or Services, or your participation in any event, even if advised of the possibility of such damages. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Swedish or EU law, including liability for death or personal injury caused by negligence, or for fraud.
11. Indemnification
You agree to indemnify and hold harmless Midsommardans and its organizers and volunteers from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Site or Services, or your participation in an event.
12. Privacy
Our collection and use of personal information in connection with the Site and Services is described in our Privacy Policy. By using the Site, you consent to the collection and use of your information as described there.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, the law, or our Services. If we make material changes, we will update the “Effective Date” above and, where appropriate, provide additional notice. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law and Disputes
These Terms are governed by the laws of Sweden, without regard to its conflict of law principles, except where mandatory consumer protection laws of your country of residence provide otherwise. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the competent courts of Sweden, unless applicable law requires otherwise.
15. Miscellaneous
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. These Terms constitute the entire agreement between you and us regarding the Site and Services and supersede any prior agreements.
